I don't think it is legal to use transreceivers without licence even here.
All you can buy is a receiver that cannot transmit.
About emissions, if the equipment is shielded and subjected to EMC tests and radiated immunity tests these problems can be overcome by compensating or modifying these equipment. Also the cell phones need to be FCC approved ie, there are limits for spurious emissions as per CFR rules of FCC and they can be sold in the market only if their emissions are within the limits. So, the chance of these problems are rare and it possible that the older instruments were not tested to these standards and for aviation and military there are more stringent standards.
FCC rules are for North America only and in Europe they have equivalent standards CISPR, ETSI etc. I wonder if there is any in India.

Operating a Transreciever would require a Aeromobile radio licence issued by the concerned authorities.Only Radio recievers are allowed without a licence.

i believe its the DoT's Wireless Planning & Commission wing which has been given the responsibility of managing and alloting the sprectrum. They are the issuing authority for licenses. |
